GRAND ISLAND — Deputy Hall County Public Defender Vicky Kenney has filed a motion to quash 31 of 48 sex-related charges against Cody C. Holum, 17, of Doniphan.

Kenney represents Holum and filed the motion on Jan. 23 in Hall County District Court. Holum appeared in Hall County District Court Jan. 23 before District Judge Andrew Butler.

Holum faces 30 felonies and 18 misdemeanors in sex-related crimes including felony human trafficking of a minor, felony child abuse, felony terroristic threats, felony visual depiction of sexually explicit conduct, and felony first-degree sexual assault.

Holum’s bond is set at 10 percent of $500,000. Butler ruled Jan. 23 that the bond will remain as previously set, and Holum will therefore remain in jail. Hall County Attorney Marty Klein is the prosecutor.

Kenney filed a motion Jan. 23 to quash (set aside) 31 counts that Holum faces. In her motion, it says, “The defendant now and at the time the charges were filed (was) 17 years of age and still subject to the jurisdiction of juvenile court. Juvenile Court has exclusive original jurisdiction for the counts listed above” based on two statutes she cites.

Holum “requests that the Court grant the motion to quash the counts listed in the Information and referenced above for lack of jurisdiction,” Kenney wrote.

The human trafficking charges involve 11 minors.

A hearing for Holum’s case was set at 2 p.m. Jan. 30 before Judge Butler.

Originally, Holum was charged with 10 felony counts of visual depiction of sexually explicit conduct, 14 felony counts of human trafficking of a minor, one felony count of child abuse, one count of felony terroristic threats, and four felony counts of first-degree sexual assault. He is also charged with 16 misdemeanor counts of possession of child pornography and two misdemeanor counts of third-degree sexual assault.
Hall County Attorney Marty Klein filed amended charges Jan. 22.

In the amended 48 counts, Holum is charged with 10 felony counts of visual depiction of sexually explicit conduct, 11 felony counts of human trafficking of a minor, one felony count of child abuse, one felony count of terroristic threats, 16 felony counts of distribution of obscene literature, four felony counts of first-degree sexual assault, three felony counts of human trafficking, and 2 misdemeanor counts of third-degree sexual assault.
